How To Order.

After placing an order you will receive an email from us acknowledging that we have received your order. This does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us and we will confirm such acceptance to you by sending you an email confirming the shipment of your order. A contract will only be formed when we send you Shipping Confirmation. The contract will relate only to those products whose shipment we have confirmed. We will not be obliged to supply any other products which may have been part of your order. We reserve the right to cancel your order at any time before we have accepted it and we may rescind our acceptance and cancel your order where there has been an obvious error in price or where the product is no longer available.

Online Conduct/ Termination Of Usage

We can suspend or terminate your right to access (without notice) the Site for any conduct that in our sole discretion is considered to either be in violation of any law, in breach of these Terms or harmful to the interests of other users or us. We reserve the right to refuse an order from a customer.

Usage By Minors (typically persons 18 years of age or older, depending on State of residence.) 

We require that all purchases are made by individuals who are not minors and who can legally enter into binding contracts. This Site is not intended for use by persons who are minors. We cannot prohibit minors from using the Site, so we rely on parents and those responsible for supervising minors. By registering with us, buying products from us or providing us with any information, you represent that you are legally permitted to enter into a binding contract and that any information you give us is accurate, and not deceptive or misleading.

Juridiction

You agree that English law will govern these Terms and the purchase of products by you through the Site and that any dispute of any sort that might arise between you and ‘SmartVaper’ or its affiliates  shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to make changes to the Site and these Terms at any time. If any of these Terms shall be deemed for any reason to be unenforceable, that Term shall be deemed severable and shall not affect the validity and enforceability of any remaining Term and/or condition.

Pricing

Prices of products on the Site are subject to change without notice. Our Site contains a large number of products and it is possible that some of the products listed may be incorrectly priced. If a product’s correct price is higher than the price stated we will either contact you for instructions before dispatching the product or reject your order. We are under no obligation to provide the product to you at the incorrect (lower) price.

Availability

You may be able to place a product in your shopping cart and submit your order, but your order is subsequently cancelled due to unavailability of the product. Products do sell quickly and there may be a short period of time after an order has been submitted before we tell you that the product is no longer available. You accept that we may cancel your order at any time.

Shipping

You agree that credit/debit cards can be charged on the date of inventory reservation for the order, not the actual date of shipping, which may be later. The term ‘shipping’ means the commencement of shipping items in an order.

Risk Of Loss

All items purchased from ‘SmartVaper’are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon tender of the item to the carrier.

Delivery Times

Your order will be fulfilled and shipped within a reasonable time of the date of your order which will normally be in under 7 days but could be longer than 14 days in exceptional circumstances.
